Das OLG Karlsruhe<\/span> (Az. 5 WF 96\/24, Beschluss vom 16.07.2025) hat sich mit einer in der Praxis zunehmend relevanten Fragestellung besch\u00e4ftigt: Welche Auswirkungen hat ein \u00fcber den Arbeitgeber geleastes Jobrad auf die Berechnung von Unterhalt?<\/p>\n

Das Grundprinzip ist weit verbreitet: Arbeitnehmer leasen ein Fahrrad im Wege der Gehaltsumwandlung. Die Leasingrate wird dabei vom Bruttogehalt abgezogen, w\u00e4hrend lediglich der geldwerte Vorteil versteuert wird. Auf diese Weise lassen sich Steuern sparen, gleichzeitig steht ein \u2013 h\u00e4ufig hochwertiges \u2013 Fahrrad auch zur privaten Nutzung zur Verf\u00fcgung.<\/p>\n

Im Unterhaltsrecht wird dieser Umstand differenziert betrachtet. Ma\u00dfgeblich ist insbesondere, ob der Unterhaltspflichtige das Jobrad auch privat nutzen darf. Ist dies der Fall, wird lediglich der geldwerte Vorteil dem Einkommen zugerechnet. Die Leasingrate selbst bleibt bei der Ermittlung des unterhaltsrelevanten Einkommens au\u00dfer Betracht, da die steuerliche Entlastung bereits im Nettoeinkommen ber\u00fccksichtigt ist. Dadurch profitiert auch der Unterhaltsberechtigte mittelbar von dem steuerlichen Vorteil; eine zus\u00e4tzliche fiktive Steuerberechnung ist nicht erforderlich.<\/p>\n

Anders verh\u00e4lt es sich, wenn keine private Nutzung vorgesehen ist. In diesem Fall wird die Situation so bewertet, als w\u00fcrde das Jobrad nicht existieren. Es erfolgt eine fiktive Steuerberechnung, bei der das Einkommen so angesetzt wird, wie es ohne die Gehaltsumwandlung w\u00e4re. Auf diese Weise wird verhindert, dass das unterhaltsrelevante Einkommen durch entsprechende Gestaltungen zulasten des Unterhaltsberechtigten reduziert wird.<\/p>\n

Wie so h\u00e4ufig im Familienrecht kommt es auf den Einzelfall an. Eine pauschale Bewertung ist nicht m\u00f6glich. Entscheidend sind die konkreten vertraglichen Regelungen sowie die tats\u00e4chliche Nutzung. Wer ein Jobrad nutzt und zugleich unterhaltspflichtig ist, sollte daher genau pr\u00fcfen, ob eine private Nutzung ausdr\u00fccklich gestattet ist und wie hoch der angesetzte geldwerte Vorteil
