Wer nach dem Tod des Ehepartners einen Zugewinnausgleich geltend machen m\u00f6chte, sollte keine Zeit verlieren.<\/p>\n

Die Verj\u00e4hrungsfrist beginnt bereits dann, wenn die wesentlichen Umst\u00e4nde bekannt sind, insbesondere:<\/p>\n

  • der Tod des Ehepartners<\/li>\n
  • die Tatsache, dass man selbst nicht Erbe geworden ist<\/li>\n
  • die Person des tats\u00e4chlichen Erben<\/li>\n<\/ul>\n

    Dabei ist es unerheblich, ob die rechtliche Bewertung vollst\u00e4ndig klar ist.     Ein Ehepaar lebte bereits getrennt. Der Ehemann hatte die Scheidung eingereicht, verstarb jedoch vor deren Rechtskraft. Da kein Testament vorlag, wurde sein Bruder gesetzlicher Erbe.<\/p>\n

    Die Ehefrau verstarb sp\u00e4ter ebenfalls. Ihre Schwester machte daraufhin einen Anspruch auf Zugewinnausgleich geltend \u2013 also auf einen finanziellen Ausgleich f\u00fcr das w\u00e4hrend der Ehe erworbene Verm\u00f6gen.<\/p>\n

    Nach Auffassung des Gerichts h\u00e4tte die Ehefrau bereits im Jahr 2019 erkennen k\u00f6nnen, dass sie nicht Erbin wird \u2013 n\u00e4mlich mit der Entscheidung des Nachlassgerichts zugunsten des Bruders.<\/p>\n

    Ab diesem Zeitpunkt h\u00e4tte sie ihren Anspruch verfolgen m\u00fcssen.<\/p>\n

    Ein Abwarten bis zum vollst\u00e4ndigen Abschluss des Erbscheinsverfahrens ist rechtlich nicht zul\u00e4ssig.
