Der Bundesgerichtshof<\/span> hat mit Beschluss vom 31.07.2024 (Az. XII ZB 147\/24) wichtige verfahrensrechtliche Klarstellungen zur Rolle m\u00f6glicher leiblicher V\u00e4ter in Adoptionsverfahren getroffen. Besonders deutlich stellt der BGH klar:<\/p>\n

Alleinige Angaben der annehmenden Personen oder der Kindesmutter, wonach ein bekannter Samenspender mit der Adoption einverstanden sei und keine Beteiligung w\u00fcnsche, gen\u00fcgen nicht.<\/p>\n

Auch vorgelegte Nachrichten oder \u00e4hnliche Nachweise reichen nicht aus, wenn deren Echtheit nicht \u00fcberpr\u00fcft wurde.<\/p>\n

Das Gericht darf sich also nicht ohne Weiteres auf solche Erkl\u00e4rungen verlassen, sondern muss eigenst\u00e4ndig pr\u00fcfen, ob eine Beteiligung des m\u00f6glichen Vaters erforderlich ist.<\/p>\n<\/div>","detail_call_to_action_enabled.Value":"false","detail_slider_enabled.Value":"false","detail_heading.Content":"Recht auf Benachrichtigung","detail_text.Content":"

Nach Auffassung des BGH muss das grundrechtlich gesch\u00fctzte Interesse eines m\u00f6glichen leiblichen Vaters, die rechtliche Vaterstellung zu erlangen, auch verfahrensrechtlich abgesichert werden.<\/p>\n

Dies geschieht dadurch, dass das Familiengericht den m\u00f6glichen Vater gem\u00e4\u00df \u00a7 7 FamFG<\/span> \u00fcber das Adoptionsverfahren informiert. Nur so wird ihm erm\u00f6glicht, am Verfahren teilzunehmen und seine Rechte wahrzunehmen.<\/p>\n

Von einer Benachrichtigung darf nur in eng begrenzten Ausnahmef\u00e4llen abgesehen werden.<\/p>\n

Das kommt insbesondere dann in Betracht, wenn eindeutig feststeht, dass eine Beteiligung des m\u00f6glichen Vaters ausgeschlossen ist \u2013 etwa, wenn dieser ausdr\u00fccklich auf seine rechtlich gesch\u00fctzte Position verzichtet hat.<\/p>\n

Mit dieser Entscheidung st\u00e4rkt der BGH die Rechte m\u00f6glicher leiblicher V\u00e4ter erheblich. Gleichzeitig sorgt er f\u00fcr mehr Verfahrenssicherheit und Transparenz.<\/p>\n

F\u00fcr betroffene Familien, insbesondere auch f\u00fcr Samenspender, bedeutet das: Die Beteiligung am Adoptionsverfahren kann nicht ohne Weiteres ausgeschlossen werden.
